Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.135.e, the Director of Purchasing shall have the authority to enter into a contract awarded by a public procurement unit if the public procurement unit and-or the vendor agree to such an award of their contract and the procurement was accomplished under generally accepted public procurement principles. The actual award of such a contract shall be made by the applicable awarding authority.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board’s Value for “Cooperatively delivering an efficient and accessible regional inter-modal transportation network.”
The Office of Economic and Small Business Development reviewed the scope of work and determined that this project will not contain race-conscious goals for Disadvantaged Business Enterprises and the assignment for this project will be race neutral because Federal Transit Administration funds are applicable (Exhibit 1).
The purpose of this contract is to purchase 60 40-foot Gillig Low-Floor BRT Diesel Transit Buses under the Commonwealth of Virginia, Contract No. E194-75548-MA2274, Low Floor Transit Buses, Heavy Duty, 12 Year (30, 35, 40, 60 ft. sizes) with Gillig LLC. The Transportation Department needs 60 40-foot low-floor transit buses to replace buses currently operating and scheduled for end of life replacement. Gillig LLC has advised that it will deliver 30 buses by 2021 and 30 buses in 2022, as opposed to the industry standard lead-time of approximately 14 to 18 months from the notice to proceed. Additionally, using the Commonwealth of Virginia contract avoids abutting scheduled orders already committed to other transit agencies and Gillig LLC meets all the County’s technical specifications requirements. This purchase is also time sensitive and will minimize operational and administrative support needed to prepare and complete a bid and provides for additional stocking of parts available in the Virginia contract, which is more cost effective (Exhibit 2).
The Commonwealth of Virginia Request for Proposal (RFP) No. E194-193 was competitively solicited as a RFP by the Commonwealth of Virginia, through the Department of General Services, Division of Purchases and Supply and is currently in effect from June 1, 2019 through May 31, 2020, which includes a renewal period from June 1, 2020 through May 31, 2021 (Exhibit 3). The RFP posted on May 31, 2016 and publicly opened on August 15, 2016, which four contracts were awarded to four different vendors. Contract No. E194-75548-MA2274 was awarded to Gillig LLC on June 7, 2017 to provide heavy duty low-floor transit buses and equipment or products, as well as required services to maintain the provided equipment (Exhibit 4).
The purchasing agent and the Transportation Department have determined that the utilization of the Commonwealth of Virginia, Contract No. E194-75548-MA2274, Low Floor Transit Buses, Heavy Duty, 12 Year (30, 35, 40, 60 ft. sizes) will allow for the County to benefit from economical pricing and reduction in delivery time, which is guaranteed by the Commonwealth of Virginia.
Utilization of this contract will also allow the County the ability to take advantage of lower costs available through competitive pricing based on large volume discounts and economies of scales, while reducing administrative costs of project solicitation.
