Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47, Amendments, Board approval is required for contract amendment or amendments when the cumulative total amount of which is greater than execution authority of the Director of Purchasing.

Allows for the addition of electrostatic spray services at Broward County Judicial Complex West Building, Bridge 4 and Bridge 5, to mitigate the spread of COVID-19.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for this contract. Triangle Services of Florida, Inc. committed to 30% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 1).
The purpose of this contract is to provide janitorial services for Broward County Judicial Complex West Building, Bridge 4 and 5.
On December 8, 2015 (Item No. 65), the Board approved the final ranking and authorized the Director of Purchasing to approve and execute the contract with Triangle Services of Florida, Inc., for Various County Facilities (Broward County Judicial Complex West Building, Bridge 4 and Bridge 5 - Contract No. 14). On February 17, 2016, the Director of Purchasing approved the contract with Triangle Services of Florida, Inc., for Various County Facilities (Broward County Judicial Complex West Building, Bridge 4 and Bridge 5 - Contract No. 14), for a two-year term, with three one-year renewal options, in the initial two-year total estimated amount of $3,384,614, including a pass-thru allowance for services and materials in the annual estimated value of $1,000.
On February 6, 2017, the Director of Purchasing approved Amendment No. 1, which amended the initial term of the agreement to begin upon written authorization by the Notice To Proceed instead of when the agreement was fully executed and amended the agreement to include the Facility Group Identification/Details, Broward County Judicial Complex West Building, Bridge 4 and Bridge 5 - Contract No. 14 (Move In Transition Proposal). Amendment No. 1 increased the agreement’s total not-to-exceed amount by $384,020.
On March 27, 2019, the Director of Purchasing approved Amendment No. 2 to the agreement, which modified unit prices to reflect increases for year four and year five per the amended Living Wage Ordinance, approved by the Board on December 11, 2018 (Item No. 26). Amendment No. 2 increased the year four total not-to-exceed amount by $25,756 and the year five total not-to-exceed amount by $85,853, in a total not-to-exceed amount of $111,609.
Amendment No. 3 will add emergency electrostatic spray services to mitigate COVID-19 infected areas for Broward County Judicial Complex West Building, Bridge 4 and Bridge 5. The electrostatic spray services are necessary to enhance and protect the overall health, welfare, and safety of our internal and external customers at the Broward County Judicial Complex West Building, Bridge 4 and Bridge 5. Amendment No. 3 increases the total not-to-exceed amount by $700,976 (Exhibit 2).
