MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, January 12, 2021, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MOTOR VEHICLE PASSENGER DISPATCH SERVICES; AMENDING VARIOUS SECTIONS OF CHAPTER 22½ OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); PROVIDING FOR MANDATORY 24-HOUR-A-DAY DISPATCH SERVICES; PROVIDING FOR CERTAIN RESTRICTIONS ON ANNUAL OPERATING PERMITS IF FINES OR FEES ARE OWED BY APPLICANTS; PROVIDING FOR RESTRICTIONS ON ENTITIES THAT HAVE PREVIOUSLY SUBMITTED FALSE OR INTENTIONALLY MISLEADING INFORMATION; PROVIDING FOR ENFORCEMENT AND PENALTIES; AMENDING SECTION 8½-16 OF THE CODE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
This proposed Ordinance revises the regulatory requirements for certain for-hire transportation services regulated through the Environmental and Consumer Protection Division ("ECPD"). The proposed changes address a number of issues regarding vehicles for hire, including regarding availability of dispatch services and outstanding fines and fees by applicants.
The Ordinance, if enacted, would require that each holder of a Certificate of Public Necessity and Convenience identify the dispatch service it uses, and would require each dispatch service to register and to operate 24 hours a day, seven days a week. In addition, the Ordinance would require vehicle for hire permit holders and registered chauffeurs to pay all outstanding fines and fees prior to application for or renewal of their respective permits or registrations. The proposed Ordinance includes fines in excess of $500 for violations of the dispatch services requirements, and therefore approval of the Ordinance at the public hearing would require approval by a majority plus one of the Board.
