The initial contract period shall begin on the date of award and will terminate one year from that date.

In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board’s Value of “Encouraging investments in renewable energy, sustainable practices and environmental protection”; and its Goal to “Seek funding for, implement policies and pursue projects promoting, the use of alternative energies and sustainable practices”.
The Office of Economic and Small Business Development did not establish County Business Enterprise (CBE) goals for this procurement because there are no subcontracting opportunities and no certified CBE contractors available to provide these services (Exhibit 2).
The purpose of this contract is to provide for the collection and disposal of hazardous waste for the County’s residential Household Hazardous Waste Program.
The Director of Purchasing has determined the apparent low bidder, Clean Earth of Alabama, Inc., to be non-responsive for failure to comply with the Broward County Domestic Partnership Act, Section 16 ½ - 157, which is required for all contracts in an amount over $100,000. There is a $75,819 difference between the bid amount of the apparent low bidder, Clean Earth of Alabama, Inc., versus the bid amount of the recommended bidder, Clean Harbors Environmental Services, Inc.
The Solid Waste and Recycling Services Division has reviewed the bid submitted by Clean Harbors Environmental Services, Inc. and concurs with the recommendation for award (Exhibit 3). One vendor performance evaluation has been completed for Clean Harbors Environmental Services, Inc.; they have an overall rating of 4.95 out of a possible rating of 5.0.
The Purchasing Division has reviewed the prices submitted by the recommended bidder, Clean Harbors Environmental Services, Inc. It determined that the prices submitted are fair and reasonable in comparison to the current Broward County contract, and the bid prices of the competing firm (Exhibit 4).
Incumbent: Clean Harbors Environmental Services, Inc., Contract Number and Title: Contract No. OPN2116905B1, Household Hazardous Waste Collection and Disposal, Contract Term: November 6, 2018 through February 5, 2021, Expenditures to date: $659,350.
There was no protest or appeal filed regarding this procurement.
The bid validity for this project expired on November 8, 2020. The recommended bidder, Clean Harbors Environmental Services, Inc., agreed to extend its bid validity through January 30, 2021 for Bid No. OPN2120943B1.
The bid posted on June 11, 2020 and opened on July 08, 2020; two bids were received with no declinations (Exhibit 1).
