Motions A and B: In accordance with the Broward County Procurement Code, Section 21.39.b., an emergency procurement exceeding the award authority of the Director of Purchasing must be reported to the Board.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for open-end Contract No. PNC2117271B1, General Roadway and Miscellaneous Construction. DP Development of the Treasure Coast, LLC, a certified CBE firm, committed to 30% CBE participation for its contract; it has achieved 30.9% CBE participation to date (Exhibit 3).
The OESBD established a CBE goal of 35% for open-end Contract No. PNC2117217B1, Bridge and Miscellaneous Structures Repairs. FG Construction, LLC, a certified CBE firm, committed to 35% CBE participation for its contract; it has achieved 100% CBE participation to date due to the prime contractor being a CBE certified firm and performing the work with its own forces (Exhibit 4).
On November 12, 2020, the Highway and Bridge Maintenance Division requested a threshold increase for open-end Contract No. PNC2117271B1, General Roadway and Miscellaneous Construction. This increase was necessary to perform emergency general roadway work for severe pavement failures due to the flooding caused by Tropical Storm Eta, including Andrews Avenue at Prospect Road and NW 6th Avenue between Commercial Boulevard and Oakland Park Boulevard (Exhibit 1).
On November 13, 2020, the Highway and Bridge Maintenance Division requested a threshold increase for open-end Contract No. PNC2117217B1, Bridge and Miscellaneous Structures Repairs. This increase was necessary to perform emergency work for County-owned bridges due to the water damage caused by Tropical Storm Eta (Exhibit 2).
Contract Nos. PNC2117271B1 and PNC2117217B1 had the necessary pay items to complete the emergency work caused by Tropical Storm Eta. Work had to be completed immediately to ensure the safety of the traveling public throughout the County and to preserve County property. These threshold increases covered the cost for the needs of the emergency work.
