Pursuant to Chapter 32, Part II, Section 32.25 of the Broward County Administrative Code, the Port Everglades Department's Business Administration Division is required to conduct franchise evaluations annually, on a rotating basis, in such a manner whereby all franchises are reviewed within a two-year period and file a Final Franchise Evaluation Report with the Broward County Board of County Commissioners.

Summary Explanation/Background

Chapter 32, Part II, Section 32.25 of the Broward County Administrative Code ("Code") requires the County, through the Port Everglades Department's Business Administration Division, to conduct franchise evaluations annually, on a rotating basis, in such a manner whereby all franchises are reviewed within a two-year period to determine if each franchisee continues to satisfactorily meet the terms and conditions of its franchise. The Code also requires a Final Franchise Evaluation Report ("Report") to be filed with the Broward County Board of County Commissioners ("Board") within 60 days following completion of the Report. The Port Everglades Department's Business Administration Division completed the Report on November 23, 2020 (see Exhibit 1).

 

The Report covers the activities of 16 franchises (listed alphabetically) during the two-year period from July 1, 2018, through June 30, 2020. A total of ten companies are represented, as several companies have multiple franchises. Franchise categories include stevedore, cargo handler, steamship agent, tugboat or towing concern, vessel bunkering service, vessel oily waste removal service, vessel sanitary waste water removal service, and marine terminal security service.

 

Staff gave each franchisee written notice of the franchise review and the requirement to update the application information via a questionnaire (see Exhibit 2). In addition to the information submitted by franchisees, additional information and input were received from each Port Everglades Department's Division and the Port's Franchise Manager. Further input was obtained from the Broward County Environmental Protection and Growth Management Department, the Broward County Risk Management Division, the Florida Department of Environmental Protection, the Florida Department of Transportation, the U.S. Coast Guard, the U.S. Customs and Border Protection, and the U.S. Occupational Safety and Health Administration.

 

Staff has concluded that each of the responding franchisees has satisfactorily met its franchise's terms and conditions and does not have a delinquent payment history with Broward County.

 

Separate from the biennial franchise review process, staff intends to perform a full review and study of existing franchise policies and procedures to identify any changes needed to align with current port operations and practices, and will bring back to the Board any recommended changes to Chapter 32 of the Broward County Administrative Code.
