Summary Explanation/Background
Since March 10, 2020, Broward County (the "County") has been under both a state and local emergency due to the COVID-19 virus, which is a deadly and highly contagious disease. Due to this emergency, on March 20, 2020, Governor DeSantis, pursuant to his emergency authority, waived the in-person quorum requirement for local government bodies, allowing those bodies to use communications media technology ("CMT") in lieu of a physical quorum. The Governor's emergency order lapsed on November 1, 2020, and has not been renewed.

The County has many advisory boards that are subject to the requirements of Section 1-233 of the Code. Currently, Section 1-233 of the Code requires a majority of the total appointed board members to be physically present for there to be a quorum. This proposed Ordinance amends Section 1-233 to allow the use of CMT (in lieu of the in-person quorum requirement) during declared states of local emergency.
