AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO EMERGENCIES; AMENDING VARIOUS SECTIONS OF CHAPTER 8 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") REGARDING DECLARATIONS OF EMERGENCIES AND AUTHORIZED EMERGENCY POWERS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

MOTION TO ADOPT Resolution No. 2021-034 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, February 9, 2021, at 10:00 a.m., in Room 422 of the Governmental Center to consider adoption of a proposed Resolution Amending the Broward County Administrative Code, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MEETINGS; AMENDING SECTION 18.3 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
The proposed Ordinance and Resolution were prepared by the Office of the County Attorney at the direction of the Board of County Commissioners ("Board") at its meeting of December 1, 2020.

Enables the setting of a public hearing during which the Board may consider enacting the proposed Ordinance and adopting the proposed Resolution.

Summary Explanation/Background
At its November 10, 2020, meeting (Item No. 91), the Board approved the revised Comprehensive Emergency Management Plan ("CEMP"). In connection with that item, the Office of the County Attorney issued a memorandum advising that certain code provisions would need to be amended to conform them to substantive revisions to the CEMP. At its December 1, 2020, meeting, the Board directed these amendments be prepared for Board consideration.
The primary changes address new provisions in the CEMP that require the County Administrator to seek direction from the Board prior to taking certain action, including by enabling the County Administrator to call special meetings of the Board during states of emergency, consistent with the revised CEMP.
