In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE HIGHWAY BRIDGE AND MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 35% for this contract. FG Construction, LLC committed to 35.5% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. FG Construction, LLC has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

The purpose of this project is to provide all labor, materials, equipment, services, supervision, and incidentals, which include performing roadway milling, resurfacing, pavement marking, miscellaneous pavement repair activities, drainage repair work, traffic control and signalization, landscaping, signing, and pavement marking, guardrail, structures and bridge repair, maintenance of traffic and miscellaneous maintenance activities for the Highway and Bridge Maintenance Division (HBMD).

 

The apparent lowest bidder’s, Lambert Bros, Inc.’s (Lambert’s), bid amount (excluding allowance amount) was $12,980,424; the second lowest bidder’s, FG Construction, LLC’s, bid amount was $14,612,688. The dollar difference between the lowest and second-lowest bidder is $1,632,264. However, HBMD completed a project cost comparison analysis on planned projects using estimated quantities and the bid prices submitted by Lambert. Based on this analysis, it was determined that Broward County project costs could be up to $3,000,000 higher; therefore, HBMD recommended non-concurrence of award to Lambert Bros, Inc.  The Project Price comparison is attached as Exhibit 3.

 

The HBMD reviewed the bid submitted by the second lowest bidder, FG Construction, LLC, and concurs with the recommendation for award (Exhibit 4). Three final vendor performance evaluations were completed for FG Construction, LLC in the past five years and the firm has an overall rating of 3.77 out of a possible rating of 5.0.

 

The allowances in this contract in the total amount of $1,050,000 include: $100,000 for irrigation system; $300,000 for unforeseen conditions; $300,000 for parts and materials; $250,000 for specialized construction activities; $50,000 for permit fees for non-Broward County agencies; and $50,000 for security services. These allowance items must be approved by the contract administrator prior to purchase and will be reimbursed at the contractor's actual incurred cost without mark-up.

 

The prices submitted by the recommended bidder, FG Construction, LLC, have been determined to be fair and reasonable by HBMD (Exhibit 5).

 

This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that the vendor has the capacity to obtain the required guaranty.

 

FG Construction, LLC has extended its bid validity through March 16, 2021.

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar.

 

There was no protest or appeals regarding this procurement.

 

The bid posted on June 12, 2020 and opened on July 22, 2020; four bids were received with no declinations (Exhibit 1).
