Why Action is Necessary

A. Board approval is required to increase an existing capital project’s budget over 5%.

 

B. Board approval is required when the approved and negotiated FGMP is over the stipulated preliminary Guaranteed Maximum Price (GMP) established for individual Projects.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 30% for this project.

 

On September 22, 2020, the County Administrator approved, through Board Action on September 10, 2020 (Item No. 59), the Agreement for Managing General Contractor to Stiles Pirtle Joint Venture, to provide managing general contractor services for certain Broward County Judicial projects identified in County’s solicitation PNC2119163P1. Project assignments included the build out of shell space on the 17th floor of the west tower for a new Complex Trial Courtroom.

 

On October 6, 2020, the Contract Administrator approved Work Order 001 to engage the Stiles Pirtle Joint Venture in preconstruction services for the Complex Trial Courtroom project.

 

In December of 2020, after completion of preconstruction services, negotiations ensued between County Staff and Stiles Pirtle Joint Venture representatives for a FGMP. The negotiated FGMP was $1,800,000 over the GMP amount established in the original agreement, which was estimated at $3,414,104.

 

Motion A allows the transfer of $1,800,000 to the Complex Trial Courtroom Project to allow for full project funding.

 

Motion B allows for a combined FGMP in the total amount of $5,168,309 and allows for the full performance of the work without disruption.

 

The attached Amendment form has been reviewed and approved by the County Attorney’s Office, for conformance.
