In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial services airport in excess of the threshold amount provided in Section 287.017, Florida Statutes, for category five ($325,000).

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION FOR AVIATION DEPARTMENT.

 

This is the second step of a two-step procurement process. Step One qualified firms by group (Aviation Department, Port Everglades Department, or Facilities Management Division) and by Office of Economic and Small Business Development designation. Contracts were either reserved for Small Business Enterprises, County Business Enterprises (CBE), or contained CBE goal participation requirements. The Selection Committee qualified bidders from the Step One solicitation based on experience and references, financial capacity, bonding, and litigation review.

 

The Office of Economic and Small Business Development assigned a 30% CBE goal of for this contract. LEE Construction Group, Inc. has committed to 30% CBE participation, which has been reviewed and approved by the Office of Economic and Small Business Development (Exhibit 2).

 

The purpose of the Job Order Contract (JOC) is to provide means for the timely issuance of job orders for construction maintenance, renovations, repairs, and minor new construction projects for County-owned facilities based on pre-priced tasks established in the Construction Task Catalog (CTC). Minor new construction is defined as an improvement to an existing structure or building, or an extension of infrastructure or utilities. Each task in the CTC is priced based upon the County's rates and includes the cost of mobilization, labor, insurance, bonding, security badging, materials, tools, scaffolding, incidentals, and equipment necessary to accomplish the task (Exhibit 5).

 

The Director of Purchasing awarded and exectuted three JOC contracts through the clean, low bid process, in accordance with Broward County Procurement Code, Section 21.14.d, as there were no objections or protests filed from vendors or Commissioner pulls; and in accordance with Section 332.0075(3)(b), Florida Statutes, which requires approval, award, or ratification all contracts executed by or on behalf of a commercial service airport over the threshold amount provided in Section 287.017, Florida Statutes, for Category Five ($325,000). Although the Facilities Management Division is the Contract Administrator, this contract is for Broward County Aviation Department’s usage for construction at Broward County’s Fort Lauderdale-Hollywood International Airport and North Perry Airport. No purchase orders will be issued until ratification approval.

 

The agreement carries a 50% performance and payment bond. The Purchasing Division has confirmed with the surety company that the recommended firm has the capacity to obtain the required bonds.

 

The Facilities Management Division has reviewed the bid submitted by LEE Construction Group, Inc. and concurs with the recommendations for award (Exhibit 3). LEE Construction Group, Inc. has 10 performance evaluations and an overall rating of 4.40 out of possible 5.

 

There was no protest or appeal filed regarding this procurement.

 

The bid posted on July 31, 2020 and opened on September 9, 2020; eight bids were received for all groups/OESBD designations, with one declination (Exhibit 1).

Each requirement processed against the CBE Reserve open-end contract, in the initial two-year term estimated amount of $4,750,000 and the five-year amount of $11,875,00, will be funded by the appropriate source at the time of release.
