AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY CONSTRUCTION APPRENTICESHIP PROGRAM; AMENDING SECTION 26-8 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") TO DESIGNATE THE COMMENCEMENT DATE OF THE BROWARD COUNTY CONSTRUCTION APPRENTICESHIP PROGRAM; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of February 23, 2021.
What Action Accomplishes
Permits the Board to consider enacting an Ordinance amending Section 26-8 of the Broward County Code of Ordinances to establish a fixed commencement date for the Broward County Construction Apprenticeship Program.

Summary Explanation/Background
On May 8, 2019, the Board enacted an Ordinance creating the Broward County Construction Apprenticeship Program ("Apprenticeship Program"). The Apprenticeship Program requires that contractors responding to a solicitation for certain County construction projects commit to participating in an apprenticeship program registered with the Florida Department of Education or the United States Department of Labor. At least 12% of the labor hours on the construction project must be performed by apprentices employed by the contractor or its subcontractors.
Prior amendments to the Apprenticeship Program established an effective date for the commencement of the program at 60 days after the end of the current Local State of Emergency regarding COVID-19.
The proposed Ordinance provides a date certain of April 5, 2021, for the commencement of the Apprenticeship Program. The Apprenticeship Program applies only to solicitations first advertised by the County on or after April 5, 2021.

The Office of Management and Budget has advised that the proposed amendment does not require modification of the April 12, 2019, Fiscal Impact Statement prepared for the Board's initial consideration of the Apprenticeship Program. A copy of the April 12, 2019, Fiscal Impact Statement is attached as Exhibit 2.
