Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for this contract. Complete Highway Improvement, Inc. committed to 100% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

 

The purpose of this contract is to furnish, install and repair guardrail, fence, and accessories at various locations within the County in accordance with Broward County and Florida Department of Transportation standards.

 

The allowances in this contract in the total amount of $130,000 include: $20,000 for unforeseen underground conditions; $50,000 for parts on a pass-thru for miscellaneous parts, materials, and items; $50,000 for specialized construction activities and $10,000 for permits and fees. These allowance items must be approved by the contract administrator prior to purchase and will be reimbursed at the contractor's actual incurred cost, without mark-up.

 

This procurement requires a 50% performance and payment guaranty. The Purchasing Agent confirmed with the surety that Complete Highway Improvement, Inc. has the capacity to obtain the requisite guaranty.

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Complete Highway Improvement, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

The Director of Purchasing has determined the apparent low bidder, GD Supplies, LLC, to be non-responsive for failure to bid on all items of Group 1 and failure to comply with the licensing requirements of Group 2. There is a $20,290 or 5.5% difference between the Group 2 bid amount of the apparent low bidder, GD Supplies, LLC, versus the bid amount of the recommended bidder, Complete Highway Improvement, Inc.

 

The Highway and Bridge Maintenance Division has reviewed the bid submitted by Complete Highway Improvement, Inc. and concurs with the recommendation for award (Exhibit 3). There have been no vendor performance evaluations completed for Complete Highway Improvement, Inc.

 

The Purchasing Division has reviewed the prices submitted by the recommended bidder, Complete Highway Improvement, Inc. The prices submitted are considered fair and reasonable in comparison to the initial estimate, and the bid prices of the competing firms (Exhibit 4).

 

Pursuant to the solicitation document, General Conditions, Section 8, Contract Period (Open-End Contract), a 90-day contract extension is allowed if it is needed. However, if this requirement is exercised, the total contract term does not exceed the five years.

 

The bid posted on September 22, 2020 and opened on October 28, 2020; four bids were received with no declinations (Exhibit 1).

 

The bid validity for this project expired on February 28, 2021. The recommended bidder, Complete Highway Improvement, Inc., agreed to extend its bid validity through May 31, 2021 for Bid No. OPN2120600B1.

 

The Recommendation for Award was posted on the Purchasing Division website from February 11 - 19, 2021, at which time any aggrieved vendor could have protested the results. There was no protest or appeal filed regarding this procurement.
