Why Action is Necessary

Pursuant to Section 21.85.c.7 of the Procurement Code, after the final recommendation of ranking is posted, the Purchasing Director shall present the ranking to the Board in accordance with subsection 21.84.h.  Additionally, per Board policy, final ranking will be presented to the Board upon Commissioner’s request during the objection/protest period.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Values of “Cooperatively delivering an efficient and accessible regional intermodal transportation network” and “Ensuring economic opportunities for Broward’s diverse population and businesses.”

 

The procurement was solicited to engage the services of a qualified firm to develop a prioritized schedule of signalized intersection capacity improvement projects.

 

On October 6, 2020 (Item No. 55), the Board approved Request for Proposals (RFP) No. PNC2121497P1 for Countywide Intersection Improvements Prioritization Study.  The RFP was advertised and, at the time of the opening deadline on November 4, 2020, four firms submitted proposals.

 

On January 11, 2021, an Initial Evaluation Committee meeting was held. The Evaluation Committee determined that all four firms were both responsive and responsible to the RFP requirements and voted in favor of them advancing to be numerically scored and ranked by the Evaluation Committee.

 

On February 3, 2021, a Final Evaluation Committee meeting was held. After presentations, evaluation, scoring and ranking, the Evaluation Committee named CTS Engineering, Inc. as the first-ranked firm (Exhibit 1).

 

The Evaluation Committee’s proposed recommendation of ranking was posted on the Purchasing Division’s website from February 10 - 12, 2021, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers.

 

The Evaluation Committee’s final recommendation of ranking was posted on the Purchasing Division website from February 16 - 22, 2021, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.

 

On February 19, 2021, a Commissioner’s Office requested the final ranking be pulled from the Low Bid Report and be presented as an agenda item for discussion to the Board. Exhibit 3 is an e-mail dated March 9, 2021 from a Committee Member regarding his scores.

 

In accordance with the Procurement Code, Section 21.84.h, after the Final Recommendation of Ranking is posted, if a protest or objection has been filed, the Director of Purchasing shall present to the Board the ranking/evaluation for approval. The Board, by majority vote, has the option to either (1) approve the Committee's ranking/evaluation recommendation; (2) reject all submittals; or (3) send the ranking/evaluation back to the Committee to consider new significant information and either ratify the ranking/evaluation or reorder the list. The Board, by super majority vote, has the option to rerank/reevaluate the shortlisted firms following presentations to the Board.
