Why Action is Necessary

Broward County Board of County Commissioners approval is required for the execution of an Amendment to an Agreement that would extend the contract to more than five years, as required by Section 21.43 of the Broward County Procurement Code.

Allows for the continuation of existing economic impact analysis services until a new solicitation for similar services is completed.

Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

This item supports the Broward County Board of County Commissioners’ (“Board”) Value of "Ensuring economic opportunities for Broward’s diverse population and businesses" and the Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."

 

On November 10, 2015 (Item No. 37), the Board approved an agreement with John C. Martin Associates, LLC (“Martin Associates”) to provide economic impact analysis services to the Port Everglades Department, consisting of preparing both annual reports by Fiscal Year, and project-specific analyses, with an effective date of January 19, 2016. The agreement included both Basic Services and Optional Services during the initial three-year term and two optional one-year renewal terms. The County exercised both one-year option terms, which expired on January 18, 2021. The Agreement also provided that the Purchasing Director could extend the term for not more than three additional months beyond that. An additional three-month extension was approved by the Purchasing Director on December 1, 2020, extending the Agreement term through April 18, 2021.

 

Due to unanticipated delays in the development and advertisement of a new Request for Proposal (“RFP”) for economic impact analysis services, staff is recommending approval of the First Amendment to the Agreement with Martin Associates to allow the services to continue to be provided through December 31, 2021. This will provide sufficient time for the RFP process to be completed.

 

Services to be provided by Martin Associates during the period covered by the First Amendment will include completing the Port Everglades Fiscal Year 2020 Economic Impact Report and providing individual project-specific economic impact analyses required to submit capital grant applications and to assess the economic impact of agreements with port users.

The estimated cost of the amended contract term is a not-to-exceed $11,031.33. Martin Associates has provided services totaling $111,363 over the term of the existing Agreement.
