Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

In 2005, the City of Coral Springs planned to construct a Neighborhood Transit Center. Broward County agreed to transfer 95% of the transit concurrency fees collected from development projects in the vicinity, to the City, to partially fund construction of the facility. This was formalized in a Traffic Concurrency Agreement (recorded in Official Records Book 40150, Page 1725.)

 

The City no longer intends to construct the Neighborhood Transit Center and Broward County Transit is currently providing bus stops to serve the area. Therefore, staff recommends that the Agreement be terminated and that future transit concurrency fees be allocated for transit projects within the North Central Concurrency Service Area.

 

The Termination Agreement (Exhibit 1) has been approved as to form by the Office of the County Attorney and was executed by the CRA and City of Coral Springs, on February 22, 2021 and March 15, 2021 respectively.

Fiscal Impact

Fiscal Impact/Cost Summary

Since 2005, no development projects have paid transit concurrency fees within the geographic area covered by the Agreement. Therefore, no fees have been transferred to the City of Coral Springs or the CRA under this Agreement. Termination of the Agreement will result in future funds remaining with Broward County. (Currently, there is one pending development project that will be assessed $32,000 in transit impact fees.)
