What Action Accomplishes

A. Adoption authorizes distribution of local match funding from Broward County to various service providers as required by Section 394.76(9)(a), Florida Statutes. This action further authorizes the County Administrator to execute the individual agreements with the service providers.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable” and the goal to “effectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” Local match funding supports the provision of an array of mental health and substance abuse treatment services in the community.

 

In accordance with Section 394.76(9)(a), Florida Statutes, Broward County must provide local match funds to community mental health and substance abuse treatment service providers based on the fiscal year 2020 funding allocated by State of Florida Department of Children and Families, Circuit 17. The statute also requires these funds be provided at a 75-to-25 state-to-local ratio. Section 394.67(14), Florida Statutes, defines local matching funds as monies received from governing bodies, including city commissions, county commissions, district school boards, special tax districts, private hospital funds, private gifts (both individual and corporate), bequests and funds received from community drives or any other sources. Broward Behavioral Health Coalition (“BBHC”) is responsible for the local management and oversight of these services, including tracking and monitoring outcome achievement for its service providers.

 

The local match application process is conducted each Fiscal Year; thus, the agreement period is aligned with the state fiscal year. Eleven service providers qualified for funding in the total amount of $1,796,029 (Exhibit 1, Attachment A). Broward County will utilize the previously approved local match funding standard form agreement for agreements with the service providers, subject to review for legal sufficiency by the Office of the County Attorney. While there are no Broward County outcomes for these agreements, BBHC reported that three service providers had findings requiring a corrective action plan for the period of July 1, 2020 to December 31, 2020 (Exhibit 2).

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer ... shall have or hold any employment or contractual relationship with any business entity ... which ... is ... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 3 and constitute full disclosure of any existing conflicts.

The Fiscal Year 2020-2021 local match amount of $1,305,645 is available in the Community Partnerships Division, Health Care Services Section budget. Additional funds in the amount of $490,384 are requested in the second supplemental budget on the current agenda and will be disbursed upon approval of the total amount of $1,796,029.
