MOTION TO ADOPT Resolution No. 2021-139 approving the Second Amendment to the Public Transportation Grant Agreement with the State of Florida Department of Transportation for Financial Project No. 440132-1-94-01; increasing the total cost of the Grant Phase for the Passenger Loading Bridges project at the Broward County’s Fort Lauderdale-Hollywood International Airport and each party’s share of such costs; authorizing the Mayor or Vice-Mayor to execute same; authorizing the County Administrator to take the necessary administrative and budgetary actions; and approve any nonmonetary amendments subject to the Office of the County Attorney approving as to legal sufficiency; and providing for severability and an effective date. This Amendment to the Public Transportation Grant Agreement will provide additional grant funding up to a maximum amount of $1,253,750 and requires the County to match a minimum amount of $1,253,750, and any Project cost overruns. A certified copy of the approved Resolution shall be inserted as Exhibit D to the Public Transportation Grant Agreement before execution.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action approves the Second Amendment to the FDOT Public Transportation Grant Agreement (“PTGA”) to accept additional grant funding for the Passenger Loading Bridges Project.
On February 11, 2020 (Item No. 2), the Board approved an FDOT PTGA for Financial Project No. 440132-1-94-01 to accept funding for the Passenger Loading Bridges Project (“Project”) at FLL. FDOT committed to 50% funding of the Grant Phase up to a maximum amount of $3,000,000 and required the County to fund all expenses for the Project in excess of FDOT’s funding, estimated to be in the amount of $3,000,000.
On May 5, 2020 (Item No. 3), the Board approved the First Amendment to the PTGA to increase FDOT’s funding by $940,000 and its share to a maximum amount of $3,940,000 or 50% of the Grant Phase, and the County’s share increased to $3,940,000, while continuing to cover any Project cost overruns.
The Project will replace 39 Passenger Boarding Bridges (“PBBs”) at FLL. The existing PBBs were installed as early as the year 2000. The average life expectancy of these bridges is 20 years; however, this has been accelerated due to FLL’s proximity to the ocean and increased humidity in South Florida. The 39 PBBs were surveyed and determined to be in need of replacement based on rust, wearing parts, life cycle of parts, and years of service.
This action is to accept additional grant funding in the amount of $1,253,750 as part of the proposed Second Amendment to the PTGA. The total estimated cost for the Project is $41,550,000. Approval of this action brings the total FDOT PTGA funding for the Project to $5,193,750. The PTGA is phased to allow for future grant opportunities if they become available.
The proposed Second Amendment to the PTGA was reviewed by the Office of the County Attorney. The Amendment does not include the County's standard Agreement provisions as FDOT requires the County to use its form Amendment.
