Why Action is Necessary

Broward County Board of County Commissioners (“Board”) approval is required to authorize the Director of Aviation to execute an amendment to the Signatory Terminal Building Lease Agreement (“Signatory TBLA”) with Spirit Airlines, Inc. (“Spirit”) for temporary leased space that exceeds the original six month term.

Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This action authorizes the Director of Aviation to execute an amendment to permit the COVID-19 testing operation to continue at FLL for an additional period not to exceed six months.

 

The COVID-19 pandemic has made a lasting impact on the aviation industry. With testing requirements in place by certain domestic and international destinations in the fall of 2020, the offering of testing was an amenity that the Board desired to offer to FLL’s traveling public. Broward County Aviation Department (“BCAD”) staff discussed with interested airlines the possibility of a partnership in order to offer a COVID-19 testing operation at FLL.

 

Spirit expressed a desire to offer COVID-19 testing at FLL and entered into a contract with Nomi Health, Inc. (“Nomi”) for the administration of the testing operation at FLL. The Signatory TBLA with Spirit authorizes the Director of Aviation to execute an amendment for the use of temporary additional space for a period of time not to exceed six months during any consecutive 12-month period. On December 3, 2020, the Director of Aviation executed Amendment No. 10 to the Signature TBLA with Spirit in order to implement the testing operation at FLL. Amendment No. 10 provided for a six month period for the testing operation, which will expire on June 2, 2021.

 

The testing site started operating on December 9, 2020, in Terminal 3 with tests offered to all ticketed passengers. As of March 29, 2021, over 19,000 tests have been administered by Nomi at the FLL testing site.

 

Because the testing requirements are still in place for many domestic and international destinations and in order to assist FLL’s recovery by facilitating this amenity to the traveling public, BCAD is requesting authorization for an extension to the existing testing operation. This action authorizes the Director of Aviation to execute an amendment to the Signatory TBLA, which will permit the continued occupancy of space in Terminal 3 for a period not to exceed six months commencing on June 3, 2021 through December 3, 2021.

 

The resulting amendment will be reviewed as to form and legal sufficiency by the Office of the County Attorney.
