Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, protested award, or receipt of objection from a Commissioner within five business days after receiving notice from the Purchasing Division of the intent to award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 15% for this contract. The six responding bidders did not meet the CBE goal after being afforded the opportunity to provide executed CBE Letter(s) of Intent of their CBE commitments and/or documentation of their good faith efforts to same. OESBD conducted research with the bidders and the client agency, Water and Wastewater Services. The six responding bidders were given a second opportunity to provide executed CBE Letter(s) of Intent of their CBE commitments and/or documentation of their good faith efforts to same. The recommended bidder, Envirowaste Services Group, Inc., has committed to 3.3% CBE participation, which has been reviewed and approved by OESBD. Based on this information, OESBD has determined that the 15% CBE goal recommendation is not achievable for this solicitation and requests the acceptance of the reduction of the CBE goal from 15% to 3.3% (Exhibit 2).

 

The purpose of this contract is to provide a survey and assessment of Broward County's sanitary sewer system, which consists of over two million linear feet of sewer mains. This contract will provide both preventative and corrective maintenance with urgent repair services, which includes gravity sewer cleaning, televising, and grouting.

 

The allowances incorporated in this contract, in the total amount of $60,000, include $5,000 for permit fees, $15,000 for waste disposal fees, and $40,000 for specialty subcontractor services. Expenditures under these allowance items must be approved by the Contract Administrator and will be reimbursed at the contractor’s actual incurred cost, without mark-up (Exhibit 1).

 

Water and Wastewater Services has reviewed the bid submitted by Envirowaste Services Group, Inc. and concurs with the recommendation for award (Exhibit 3). Three vendor performance evaluations have been entered for Envirowaste Services Group, Inc.; they have an overall rating of 2.93 out of a possible rating of 5.0.

 

The Director of Purchasing has determined the apparent low bidder, Clean Grounds, Inc., to be non-responsive to the bid requirements. The bidder did not bid on all line items, as the specified basis of award and required in the solicitation; the bidder bid on 18 of the 41 line items.

 

The bid posted on October 12, 2020 and opened on November 05, 2020; six bids were received with one declination (Exhibit 1).

 

The bid validity for this solicitation expired on March 04, 2021. Envirowaste Services Group, Inc. agreed to extend its bid validity through May 04, 2021.

 

The amounts referenced in this agenda have been rounded to the nearest whole dollar.

 

The Recommendation for Award was posted on the Purchasing Division website from February 12 - February 19, 2021, at which time any aggrieved vendor could have protested the results. There was no protest or appeal filed regarding this procurement.
