MOTION TO AUTHORIZE County Administrator to execute Assignments of Mortgages and Assignments of Promissory Notes, each in substantially the form attached as Exhibit 2 and Exhibit 3, as may be needed to correct mortgagees on certain Broward County federal and state funding single family mortgages and notes in order to reflect the appropriate funding municipality.

Why Action is Necessary

A. Board action is required to amend Five Year Strategic Consolidated Plans and Annual Action Plans for HUD to add additional HUD funding allocations and implement substantial changes to program funding allocations and priorities.

 

B. Grants the County Administrator the authority to take corrective action on existing mortgages and promissory notes where the County is erroneously designated as mortgagee.

 

What Action Accomplishes

A. Approves changes to the Five Year Strategic Consolidated Plans and associated Annual Action Plans, and subsequent budgetary and administrative actions.

 

B. Allows for corrective action on mortgages and promissory notes mistakenly assigned to Broward County and Assigns the mortgages and promissory notes to reflect the appropriate funding municipality.

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE HOUSING FINANCE AND COMMUNITY REDEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Board's value: Offering sustainable, compatible, innovative housing options for all income-levels, including integrated, permanent supportive housing, and the corresponding goal of increasing the availability of affordable housing of all types, countywide in every community using effective, uniform criteria, policies, and strategies.

 

A. Amendments to the five-year consolidated plans and annual action plans are needed to accommodate substantial changes requested by HUD, the participating small cities, the Consortium Entitlement municipalities and the Housing Finance and Community Redevelopment Division for projects funded with CDBG, CDBG-CV and HOME funds. This motion will authorize the County Administrator to perform the necessary administrative and budgetary actions to implement the Activities/Projects below. The requested changes summarized below and detailed on Exhibit 1 attached, effectively provide modifications to allow successful and timely implementation of these grant funds.

City of Coconut Creek

 

On October 20, 2020 (Item No. 39), the Broward County Board of County Commissioners (BOCC) authorized the County Administrator to take all budgetary and administrative actions to enter into Interlocal Agreements (ILA) to Implement the City of Coconut Creek’s CDBG Grants. Similarly, the BOCC approved the HFCRD’s implementation of the City’s HOME grants during the Yearly Consolidated and Annual Action Plan Agenda Items (December 8, 2020, Item No. 15) and (June 2, 2020, Item No. 20) for the HOME grants. The County’s Housing Finance and Community Redevelopment Division (HFCRD) subsequently entered into the ILA’s to implement the referenced grant programs. After further fiscal reconciliation, the City notified the County that there were some balance adjustments that needed to be made to the current ILA’s. In addition to those adjustments, the City has Fiscal Year 2016 HOME grant funding balance and program income (PI) that needs to be recognized and included in the current ILA in the form of an amendment. The HOME Fiscal Year 2016 and PI funds were not part of the above referenced Agenda Items.

City of Hallandale Beach

 

The Broward County Board of County Commissioners approved the CARES Act Community Development Block Grant Coronavirus (CDBG-CV) funds allocation on June 2, 2020, Item No. 20. The City of Hallandale Beach requested the changes detailed on Exhibit 1.

 

B. In addition to the County’s state and federal grants, the Broward County Housing Finance and Community Redevelopment Division (HFCRD) administers and Implements various state and federal programs for other entitlement and non-entitlement municipalities. As such, Broward County provides the administration and implementation for various municipalities’ CDBG, HOME and SHIP grants, which includes Housing Rehabilitation and Down Payment/Purchase Assistance programs. The program’s mortgages and promissory notes sometimes erroneously named Broward County as the Mortgagee.  The mortgages and promissory notes should name the funding municipality as the mortgagee. These assignments take corrective action in order to reflect the appropriate funding municipality. The Assignment of Mortgage and Note forms, Exhibit 2 and Exhibit 3, were created, and approved by the office of the County Attorney.
