Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On October 20, 2020, Agenda Item 42, the Board of County Commissioners approved the License and Concession Agreement between Broward County and BikeBox, LLC (“BikeBox”) for Bicycle Rental and Concessionaire Services at Markham Park and Quiet Waters Park (“Agreement”). The Agreement provided for project completion, including phases, deliverables, and construction, at Markham Park within four months of the Effective Date, and project completion, including phases, deliverables, and construction, at Quiet Waters Park within six months of the Effective Date.
As a result of the ongoing COVID-19 public health emergency, Markham Park has been operating as a COVID-19 vaccination site since January 1, 2021, which has impacted BikeBox’s ability to complete its work. BikeBox has requested additional time to meet the requirements of project phases outlined in the Agreement. The First Amendment establishes updated timelines for the project phases and deliverables, extending the Markham Park project completion from four months to ten months from the original Agreement’s Effective Date, and extending the Quiet Waters Park project completion from six months to 12 months from the original Agreement’s Effective Date. All other terms and conditions of the Agreement remain the same.
The First Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
