Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On June 12, 2018, Agenda Item 43, the Board of County Commissioners approved the License and Concession Agreement between Broward County and U.S. Soccer 5, LLC (“Soccer 5”) for Mini-Soccer Fields and Food and Beverages Concessions at Brian Piccolo and Tradewinds Parks (“Agreement”). The Agreement provided for full project completion, including phases, deliverables, and commencement of operations, within 24 months of the Effective Date. On October 6, 2020, Agenda Item 39, the Board of County Commissioners approved a First Amendment to the Agreement, revising Exhibit G, Project Phases and Deliverables. The timeline for construction completion and commencement of operations was extended for both Brian Piccolo and Tradewinds projects.
As a result of the ongoing COVID-19 public health emergency, which has impacted Soccer 5’s business operations, Soccer 5 requested additional time to complete construction and commence of operations, as outlined in the First Amendment. The Second Amendment restructures the projects’ phases and deliverables exhibit, Exhibit G-2, to allow completion of the Brian Piccolo Park to be completed first, within 180 days after the Second Amendment Effective Date. The revised full project completion date for Tradewinds Park is to September 30, 2023. Exhibit G-2 Phases 1 and 2, as revised, relate directly to the Brian Piccolo project: construction permitting, construction completion, and concession operations commencement. Phases 3 through 6 relate to the Tradewinds Park project: softball and soccer concessions operations, financing commitment, construction permitting, construction completion, and concession operations commencement. Phase 7 provides for the continued review of operations at both facilities for the duration of the Agreement. All other terms and conditions of the Agreement remain the same.
The Second Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
