Summary Explanation/Background
THE TRANSPORTATION DEPARTMENT, PUBLIC WORKS DEPARTMENT, AND THE OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMEND APPROVAL OF THE ABOVE MOTION.
Contract No. V2113899B1 for Information Technology (IT) Temporary Personnel Services was awarded by the Board (Item No. 29) on September 14, 2017. The contract period began effectively on October 12, 2017 and expired on October 11, 2020. A 90-day extension was exercised, and the contract was extended until January 9, 2021.
Solicitation No. TRN2121458B1, advertised on August 7, 2020 and ending on August 26, 2020, resulted in a Reject-All. The IT Temporary Personnel used by the Transportation Department are funded with Federal Transit Administration (FTA) funds and the FTA requires the hourly wages paid by the vendors to each of the temporary personnel meet or exceed the threshold established by the FTA. The FTA uses the wage rate published by the U.S. Bureau of Labor Statistics (BLS) for each job position in the Fort Lauderdale/ Miami Metropolitan Statistical Area as a benchmark.
The vendor responses to Solicitation No. TRN2121458B1 did not indicate how they would meet this criterion. As a result, BCT issued a Non-Concurrence Memorandum on December 1, 2020 for the rejection of Solicitation No. TRN2121458B1 and immediately requested a month-to-month interim contract, not exceeding five months, with the current vendor, 4 Best Business Corp. to maintain continuity of services in the IT Section. Interim Contract No. TRN2122178X1 commenced on January 5, 2021 and expires May 9, 2021.
A new solicitation (TRN2122277B1) was advertised on February 2, 2021 and closed on February 17, 2021. On April 29, 2021, a formal protest was received for the recommended vendor listed on the Recommendation of Award. As a result, the award of a new contract for IT Temporary Personnel Services will be delayed until a review and response to the protest is issued.
The continuation of services provided by the IT temporary personnel through this interim contract is critical to the operational needs of the Transportation and Public Works Departments and the Office of Regional Communications and Technology (ORCAT) and other agencies. The estimated six-month cost is $331,392.
