A.                     Board of County Commissioners’ approval is required to enter into legal agreements with the Florida Department of Transportation.

Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL

 

This item supports the Board of County Commissioners' Value of "cooperatively delivering an efficient and accessible regional intermodal transportation network" with the Goal of supporting "the development, design and construction of sustainable, multi-modal transportation facilities throughout the County, to meet the demands of residents, travelers, and businesses."

 

As part of the Broward County Mobility Advancement Program, Adaptive Traffic Control Systems (ATCS) are being installed throughout the County. The FDOT roadway improvements project along University Drive overlaps with the County’s planned ATCS installations along SR 817/University Drive from north of SR 84 to north of NW 1st Street. Broward County and FDOT have determined that it is in their mutual interest to include the County’s work in the FDOT project. Broward County’s contribution to FDOT provides for engineering design and construction services for County ATCS deployment within the limits of the FDOT project.

 

On December 8, 2020 (Item No. 4), the Board of County Commissioners approved a Locally Funded Agreement with FDOT for design services of an Adaptive Traffic Control System along SR 817/University Drive from north of SR 84 to north of NW 1st Street to be included as part of FDOT’s roadway improvements project, at a cost of $56,509 to the County. The design is nearing completion.

 

Motion A seeks Board approval of a Locally Funded Agreement between Broward County and FDOT to provide for the County to pay FDOT the estimated amount of $421,663 to incorporate the County’s Adaptive Traffic Control System into the FDOT’s construction project (Exhibit 1). The total estimated cost of FDOT’s construction project including the County portion of the work is $10,380,109.

 

Motion B seeks Board approval to authorize the County Administrator to execute a Three-Party Escrow Agreement with FDOT and the State of Florida, Department of Financial Services, Division of Treasury providing payment for the County’s Adaptive Traffic Control System to be incorporated into FDOT’s roadway improvements project (Exhibit 2). FDOT requires payment in full for the County’s cost of $421,663 within 30 days of execution by FDOT of the Locally Funded Agreement in Motion A.

 

The Locally Funded Agreement and the Three-Party Escrow Agreement have been reviewed and approved as to form by the County Attorney’s Office.
