Why Action is Necessary

In accordance with Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000 inclusive of the value of any renewals or extension provided for in the contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development did not reserve this procurement for County Business Enterprises (CBE) or assign CBE goals for this procurement due to no certified CBEs available to provide these services and no CBE subcontracting opportunities (Exhibit 2).

 

The purpose of this contract is to provide the furnishing of all labor, materials, equipment, and incidentals required for the delivery of ready mixed concrete to Broward County construction job sites.

 

The Director of Purchasing has determined the apparent low bidder, VPR Construction Corp., to be non-responsive to the bid requirements. VPR Construction Corp. failed to include all pricing in its unit prices offered on the Item Response Form, in accordance with Specifications and Requirements, Section 4, which reads “include full compensation for the specified ready mixed concrete including delivery at the construction job site and any regulatory and environmental impact fees”. The vendor listed additional cost elements in its bid submittal in vendor comments and did not include in its unit pricing (i.e., fuel charges, environmental fees, standby time, etc.).  There is a $191,726 difference between the bid offered by the apparent low bidder, VPR Construction Corp., and the recommended bidder, FG Construction LLC.

 

The Highway and Bridge Maintenance Division reviewed the bid submitted by FG Construction LLC and concurs with the recommendation for award (Exhibit 3). Three performance evaluations for FG Construction LLC were completed; they have an overall rating of 3.77 out of a possible 5. Copies of the vendor performance evaluations are available upon request.

 

The Purchasing Division has researched the prices submitted by the recommended bidder, FG Construction LLC, and determined the prices are fair, reasonable, and aligned with the estimate (Exhibit 4).

 

Incumbent: FG Construction LLC; Contract Number and Title: BLD2115927B1, Ready Mixed Concrete for Highway and Bridge Maintenance Division. Contract Term: June 5, 2018 through June 4, 2021. Expenditures to date: $701,649.

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

 

The Recommendation for Award posted on the Purchasing Division website from April 30, 2021 through May 6, 2021. There was no protest or appeal filed regarding this procurement.

 

The bid posted on March 16, 2021 and opened on April 14, 2021; two bids were received with no declinations (Exhibit 1).
