MOTION TO AWARD open-end contract to low responsive, responsible bidder, Enviroscapes Plus Inc., for Wetland Mitigation Site Maintenance, Bid No. BLD2122216B1, for the Solid Waste and Recycling Services Division, in the annual estimated amount of $197,500, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a total three-year potential amount of $592,500. The initial contract period shall begin on the date of award and shall terminate one year from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000 inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISON RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) did not establish County Business Enterprise (CBE) goals for this procurement. OESBD reviewed the Certified Firm Small Business Directory and identified eight CBE firms under the NAICS Code 561730. However, none of the eight CBE firms is a wetland mitigation specialist and/or has experience or knowledge in the eradication and control of exotic and nuisance vegetative species (Exhibit 2).
The purpose of this contract is to furnish all labor, materials, and equipment for wetland mitigation site maintenance for the Solid Waste and Recycling Services Division (SWR).
In accordance with the Broward County Living Wage Ordinance, Broward County Code of Ordinances, Section 26-101 (i), these services are covered services. Enviroscapes Plus Inc. (Enviroscapes) has agreed to be bound to the contractual obligations of the Living Wage Ordinance.
SWR reviewed the bid submitted by Enviroscapes and concurs with the recommendation for award (Exhibit 3). There have been no vendor performance evaluations completed for Enviroscapes.
The Purchasing Division researched the prices submitted by the recommended bidder, Enviroscapes, and determined that the prices submitted are fair and reasonable in comparison to prices of the competing firms and current contract prices (Exhibit 4).
On April 27, 2021, the Director of Purchasing approved the rejection of low bidder, Environmental Quality, Inc., due to the firm not providing prices for Line No. BLD2122216B1--01-06 through BLD2122216B1--01-07 from Group 1, and Line No. BLD2122216B1--02-01 through BLD2122216B1--02-32 from the entire Group 2. Pursuant to the solicitation document, Bid Comments, Addendum No. 1, Section No. 5, Basis of Award, states that the “County intends to award to the low responsive, responsible bidder for the total of all items on the Item Response Form”, which extended the bid advertisement for nine business days.
Incumbent Vendor: Environmental Quality, Inc., Contract Number and Title: Contract No. BLD2119909X1_1, Wetland Mitigation Sites Maintenance (Interim), Contract Term: October 24, 2019 through April 23, 2020, Expenditures to date: $33,250.
The Recommendation for Award posted on the Purchasing Division website from April 28, 2021 through May 4, 2021. There was no protest or appeal filed regarding this procurement.
The bid posted on March 2, 2021 and opened on March 24, 2021; three bids were received with three declinations.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
