Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Value for "Ensuring economic opportunities for all people and businesses in Broward County," its Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs" and its Objective to increase passenger facilities in Terminal 4 at Broward County’s FLL.

 

This action amends the WA to continue providing CPM Services for the T4 Gate Replacement project at FLL. 

 

The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 25% for this project.  Turner Construction Company (“Turner”) committed to 28.20% CBE participation.  To date, Turner has been paid $63,882,336 and has paid CBE firms $23,462,926 for 36.73% participation (Exhibit 2).

 

On February 14, 2012 (Item No. 35), the Board approved the deliberately phased Work Authorization No. WA001TC, in accordance with the CPM Library Agreement between Broward County and Turner for CPM Services for the T4 Gate Replacement project.  The WA added the T4 Western Expansion project in the amount of $25,175,738, with a time period commencing upon Board approval and ending upon completion of all warranty periods for the T4 Western Expansion project.  Additional information on the original WA and subsequent Board actions is included in Exhibit 3. 

 

The T4 Gate Replacement project is comprised of the T4 Western and Eastern expansions, T4 Apron Paving, T4 Checked Baggage Inspection System, and T4 Federal Inspection Services (“FIS”) projects.  Construction of these projects except the T4 FIS Facility, is complete and the contractors are working towards substantial completion and project close-out. Due to the COVID-19 pandemic, there is less construction workers availability and there are supply chain delays for the T4 FIS Facility project.  In addition, the security requirements for U.S. Customs and Border Protection were revised, which impacted the T4 FIS Facility project.  Substantial completion of the T4 FIS Facility project is now anticipated for the Fourth Quarter of 2021. Continued CPM Services are necessary in order to complete these deliberately phased projects, address unresolved disputes, and close out the construction contracts.

 

Approval of the proposed Fifth Amendment to the WA decreases the lump sum amount for Professional Services by $75,000, and increases the maximum not-to-exceed amount for Professional Services by $3,608,738, for a total Professional Services increase of $3,533,738, with no change to the previously approved Reimbursable amount of $2,277,437, for a revised total WA amount of $69,614,884.

 

This Fifth Amendment to the WA has been reviewed and approved as to form by the Office of the County Attorney.
