MOTION TO AUTHORIZE County Administrator to take any and all necessary actions as needed, including execution of agreements, contract amendments, work authorizations, construction change orders and other administrative documents to provide for continued design, project management, construction services, and other approvals deemed necessary in relation for new and on-going projects located within the Broward County Judicial Complex by Spillis Candela Partners/Heery/Cartaya Joint Venture, The Weitz Company, Synalovski Romanik Saye, EAC Consulting Inc., and other vendors and suppliers  as deemed necessary, subject to the Office of the County Attorney approving any contracts, amendments, or work authorizations as to legal sufficiency, during the Board of County Commissioners' 2021 summer break. Why Action is Necessary

MOTION A: Board approval is required to increase existing capital project budgets over 5%.

 

MOTION B: Board of County Commissioners’ approval is required to delegate authority to the County Administrator when the approved and negotiated FGMP is over the stipulated preliminary Guaranteed Maximum Price (GMP) established for individual Projects.

 

MOTION C: Board of County Commissioners’ approval is required to delegate authority to the County Administrator to enter into agreements and execute work authorizations, amendments, and other administrative documents with either a dollar value in excess of the Purchasing Director's authority or that otherwise require Board of County Commissioners’ approval while the Board of County Commissioners is not in session.

Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL.

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 30% for the Broward County Judicial Complex Projects.

 

On September 22, 2020, the County Administrator approved, through Board Action on September 10, 2020 (Item No. 59), the Agreement for Managing General Contractor to Stiles Pirtle Joint Venture, to provide managing general contractor services for certain Broward County Judicial projects identified in County’s solicitation PNC2119163P1. Project assignments included the replacement of the generator and switchgear that services the East Wing, the relocation of the Clerk of Courts Copy Center, and the installation of a water meter at the Main Jail.

 

On December 24, 2020, the Contract Administrator approved Work Orders 003, 004, and 005 to engage the Stiles Pirtle Joint Venture in preconstruction services for the East Wing Generator and Switchgear Replacement, Clerk of Courts Copy Center Relocation, and a New Jail Water Meter.

 

After completion of preconstruction services, negotiations ensued between County staff and Stiles Pirtle Joint Venture representatives to establish the FGMPs for the projects.

 

The negotiated FGMP for the East Wing Generator and Switchgear Replacement project is in the total amount of $6,096,516 with a duration of 434 calendar days. The negotiated FGMP amount is over the estimated GMP amount of $4,387,443 approved in the original agreement. The generator and switchgear have reached the end of their viable life cycle. This equipment provides emergency power to the East Wing and North Wing buildings.  Parts to repair the equipment are becoming increasingly expensive and obsolete. Replacement of the equipment is necessary to maintain emergency power to operate the fire alarm, fire suppression, emergency lighting and elevator systems in East and North Wings of the Complex, during power outages.

 

The negotiated FGMP for the Clerk of Courts Copy Center Relocation project is in the total amount of $1,368,224 with a duration of 250 calendar days. The negotiated FGMP amount is over the estimated GMP amount of $703,399 approved in the original agreement. The Copy Center will be relocated from the third floor of the East Wing to 515 SW 2nd Avenue in Fort Lauderdale. This is a critical enabling project required to allow for full renovation of the East Wing building and necessary to maintain the Broward County Judicial projects’ schedule.

 

The negotiated FGMP for the New Jail Water project is in the total amount of $653,451 with a duration of 172 calendar days. The negotiated FGMP amount is over the estimated GMP amount of $219,376 approved in the original agreement. This project includes the installation of a dedicated domestic water service meter and vault and measure the proper water usage in the Main Jail building.

 

Motion A: Reallocates $807,640 of funding between the existing Broward County Judicial Projects budgets to support cost increases and ensure construction remains on schedule.

 

Motions B-C: Asks the Board of County Commissioners to delegate signature authority to the County Administrator to execute the outlined FGMPs as well as other contract amendments, change orders, work authorizations and other administrative documents needed to expedite services deemed necessary for the on-going and future phases of work in the Broward County Judicial Complex by the Managing General Contractor, consultants and the owner’s project management team, during the Board of County Commissioners’ 2021 summer break. These motions are presented as contingency measures in order to avoid project delays.

Fiscal Impact

Fiscal Impact/Cost Summary

$807,640 will be transferred from the Judicial Complex East Wing Enabling Work project. Pending approval of this action, the transfer will reduce the East Wing Enabling Work project’s Fiscal Year 21 Modified Budget to $9,531,540. Since this project was originally estimated, the Construction Management Division has identified cost savings. As a result, the transfer of funds to the projects described below will not impact the East Wing Enabling project’s construction schedule.

 

$255,460 of the $807,640 is transferred to the Main Jail Dedicated Water Meter project which, pending approval of this action, will increase the project’s Fiscal Year 21 Modified Budget and total estimated cost to $653,460.

 

The remaining $552,180 of the $807,640 will be transferred to the East Wing Generator and Switchgear project which, pending approval of this action, will increase the projects Fiscal Year 21 Modified Budget and total estimated cost to $6,197,180.
