In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Broward County Board of County Commissioners approval is required for awards exceeding $500,000.

Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

This action supports the Broward County Board of County Commissioners' (“Board”) Value of "Ensuring economic opportunities for Broward's diverse population and businesses" and the Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."

 

The Broward County Sheriff's Office (“BSO”) has provided seaport security and law enforcement services at Port Everglades under a series of interlocal agreements approved by the Board since the 1990’s.  The most recent agreement was approved by the Board on September 10, 2015, with an expiration date of September 30, 2020 (Item No. 32) (“Agreement”).  On September 22, 2020 (Item No. 6), the Board approved the First Amendment to the Agreement extending the term of the Agreement through December 31, 2020 while a new agreement was negotiated.

 

Negotiations between the parties have been delayed to address a number of open issues, and to include recommendations made by the County Auditor as part of an ongoing audit of BSO’s services provided to Port Everglades that is not yet complete. Approval of the Second Amendment (see Exhibit 1) will retroactively extend the existing Agreement from January 1, 2021, through September 30, 2021, so that BSO may continue providing services at Port Everglades while the new agreement is negotiated and finalized.

 

The Second Amendment to the Agreement has been approved as to form by the Office of the County Attorney.
