In accordance with the Broward County Procurement Code, Section 21.47, any changes, including amendments to agreements, must be approved by the appropriate award authority, based on the amendment amount.

Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This action extends the term of the Agreement between the County and Gresham Smith through December 31, 2024, providing for additional scope for the Terminal Modernization program at FLL.

 

This item supports the Board’s Value for "Ensuring economic opportunities for all people and businesses in Broward County," its Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs" and its Objective to modernize passenger facilities at Broward County’s FLL.

 

The Office of Economic and Small Business Development established a County Business Enterprise ("CBE") goal of 20% for this project. Gresham Smith committed to 20% CBE participation. To date, Gresham Smith has been paid $35,222,231, and has paid CBE firms $8,288,200, for 23.53% participation (Exhibit 2).

 

On January 31, 2012 (Item No. 21), the Board approved the Agreement between the County and Gresham Smith for Terminal Modernization of Terminal 1 (“T1”), Terminal 2 (“T2”), and Terminal 3 (“T3”) at FLL, for professional architectural, engineering and construction administration services, in the maximum not-to-exceed amount of $14,000,000.  Additional information on the original Agreement and subsequent Board actions is included in Exhibit 3. 

 

Gresham Smith is the primary consultant that provides professional services for the T1 Checked Baggage Resolution Area, T2 Modernization project managed by Delta Air Lines, Inc. (“Delta”), the T3 Modernization project managed by JetBlue Airways Corporation (“JetBlue”), the T2 and T3 Connector Bump-out extensions (“Bump-outs”), and the roadway and garage wayfinding signage project impacting all terminals.

 

Broward County and Delta are working on an amendment to eliminate scope from their existing agreement for the T2 Modernization Project at FLL.  The removed scope is for various modernization projects within T2 and the new Terminal Connector Program which will construct a terminal connector between T1 and T2, and a second terminal connector between T2 and T3. The proposed Sixth Amendment provides funding for Gresham Smith to revise and repackage the existing construction documents, allowing for a competitive solicitation utilizing the Broward County procurement process, and providing for enhanced Construction Administration services for the Terminal Connector Program.

 

On April 6, 2021 (Item No. 72), the Board approved additional work and time for the T3 Modernization and Bump-out projects managed by JetBlue. Gresham Smith will provide consultant services for this additional work.

 

Approval of the proposed Sixth Amendment increases labor by $9,900,000 and reimbursable expenses by $100,000, for a total increase of $10,000,000, for a revised total Agreement amount of $55,600,000, and extends the term of the Agreement to December 31, 2024.

 

The proposed Sixth Amendment has been reviewed and approved as to form by the Office of the County Attorney.
