Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board's Value of "encouraging investments in renewable energy, sustainable practices and environmental protection", with the Goal to "proactively lead in the planning, design and construction of projects supporting resilience and climate adaptation, including coordination with other entities to foster resilient design as part of local and regional projects, especially shore protection efforts".

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 25% for this project. LEO A DALY Company has committed to meet the CBE participation goal. To date, LEO A DALY Company has been paid $615,020 in fees eligible for CBE participation with CBE firms receiving $99,869, yielding an interim achievement of 16.24% participation (Exhibit 2).

 

On January 29, 2019 (Item No. 38), the Board of County Commissioners approved and executed the deliberately phased Agreement between Broward County and LEO A DALY Company, for predesign services, including programming, site analysis and public outreach, for the Medical Examiner’s Office and Broward Sheriff Office Crime Laboratory Combined Facility. The project site is located at 1625 NW 23rd Avenue, Fort Lauderdale.

 

On December 8, 2020, (Item No. 3), the Board of County Commissioners approved and executed First Amendment the Agreement between Broward County and LEO A DALY Company, for full design services, including public outreach, for the Medical Examiner’s Office and Broward Sheriff Office Crime Laboratory Combined Facility.

 

The Second Amendment to the Agreement adjusts the calendar days for the 50% Construction Document phase from 42-calendar days (which was incorrectly listed in the Agreement) to the negotiated 84-calendar days.  The Second Amendment further amends section 4.3 of the Agreement to allow the Contract Administrator to make adjustments to the time periods in the project schedule, that may be due to delays caused by the County, jurisdictional authorities and any other such delays that are no fault of the Consultant, consistent with language in the current County approved form.

 

The Motion seeks approval to adjust the 50% Construction Document phase duration for the listed number of days to allow the design consultants sufficient time to complete this phase and allows the Contract Administrator to make any necessary adjustment to the project schedule.
