A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MAXIMUM NONCONSENT RATES FOR TOWING; AMENDING SECTION 40.50 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE") TO MODIFY THE MAXIMUM NONCONSENT RATES FOR PRIVATE TOWS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary

Resolutions directing the County Administrator to publish notices of public hearing to consider enactment of the Ordinance and adoption of the Resolution were adopted by the Board of County Commissioners at its meeting of May 18, 2021.

 

What Action Accomplishes

Enables the Board to consider enacting the proposed Ordinance and adopting the proposed Resolution.

Summary Explanation/Background

At its May 18, 2021, meeting, the Board considered certain amendments to private property nonconsent towing regulations, including amendments proposed by the industry, and elected not to proceed with certain changes pertaining to after-hours access fees or special equipment fees. To facilitate consideration at the public hearing, only the amendments that the Board directed should proceed to public hearing are included in the attached Exhibits 1 and 2.

 

The proposed Ordinance, if enacted, would require towing companies to provide copies

of their County license to municipal authorities prior to operating in that municipality.

 

The proposed Resolution, if adopted, would modify the maximum fee schedule for Class A nonconsent private property tows to increase the base towing fee to $160 and the administrative fee for all nonconsent private property tows to $50.

 

The Environmental and Consumer Protection Division, the applicable regulatory agency, has reviewed the proposed code changes and has not requested any further amendments to the affected provisions.
