Why Action is Necessary

Amendment of this Interlocal Agreement must be approved by the Broward County Board of County Commissioners pursuant to Chapter 19, Part XIII of the Administrative Code.

 

What Action Accomplishes

This amendment will allow the presentation of code enforcement cases to the County’s Hearing Officer/Special Master. It will also allow the County to perform corrective actions upon failure of the violator to do so. Additionally, the amendment will allow liens from code enforcement cases to run in favor of the County and for the County to execute a satisfaction or release of the lien entered. The amendment will entitle the County to collect all costs incurred in recording and satisfying a valid lien.

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE BUILDING CODE SERVICES DIVISION (BCSD) RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

It is the policy of the Board of County Commissioners to offer building code enforcement services to local municipalities that seek to either supplement their building departments or transfer permitting responsibilities to the County in a guaranteed partial service agreement.

 

The original Interlocal Agreement was executed on February 27, 2018 and expires on September 30, 2022. The attached amendment (Exhibit 1) authorizes BCSD to bring code enforcement actions before the County’s Hearing Officer/Special Master. Fees are assessed based on the most current County fee schedule and BCSD currently provides similar services to municipalities including Cooper City, Hallandale Beach, Dania Beach, Lauderdale Lakes, Miramar, North Lauderdale, and Oakland Park.

 

The Office of the County Attorney has reviewed and approved this agreement as to form.
