In accordance with the Broward County Procurement Code, Section 21.56, Board approval is required for a change order allowance increase exceeding 10% of the original contract amount.

Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 28% for this Contract. Jones Benitez Corporation (“JBC”) committed to 90% CBE participation. To date, JBC, a certified CBE firm, has been paid $381,631 which is 100% CBE participation (Exhibit 1).

 

During the December 12, 2017, Regular Meeting (Agenda Item 38), the Board of County Commissioners approved the Contract between Broward County (“County”) and JBC for the Construction of Camping Cabins at Quiet Waters Park (the “Project”) in the amount of $709,000.

 

The building permit was issued on June 21, 2019. The Board of County Commissioners approved the Underground Distribution Facilities Installation Agreement with FPL during the November 15, 2019, Regular Meeting (Agenda Item 9). The required electrical work by FPL was completed prior to start of this project. The contractor was given time to mobilize and procure long lead time items prior to the issuance of the Second Notice to Proceed dated January 12, 2021.

 

The Project provides for construction of three camping cabins, new roadway and parking areas, utility infrastructure, site lighting, fire protection, landscaping, and irrigation.

 

To date, four change orders addressing underground utility conflicts and County requested architectural enhancements to the cabins have been processed for a total change order amount of $37,945 and a total amended contract amount of $746,945.

 

Approval of this action increases the Change Order Allowance from 8.46% to 19.46%. This will allow the Parks and Recreation Division to process anticipated change orders currently being negotiated with JBC due to limited material availability and cost increases as a result of COVID-19, code required underground utility enhancements, and to address any future unforeseen circumstances as the Project progresses to completion.

 

Construction of site infrastructure and building foundations is nearly complete. The Project is anticipated to be completed by the end of 2021.

 

This action has been reviewed and approved as to form by the Office of the County Attorney.
