AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MOTOR CARRIER PERMITS; AMENDING CHAPTER 22½ OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of August 24, 2021.

Summary Explanation/Background
Chapter 22½ of the Broward County Code of Ordinances ("Code") provides that motor carriers, including taxicabs, that operate motor vehicles upon the streets of Broward County must obtain a certificate of public convenience and necessity and a valid permit. The Code provides for a term of one (1) year for such certificates and permits, at fees set by the Board of County Commissioners ("Board") by resolution.
Currently, the Code does not permit the Board to modify the term of a certificate or permit or to waive the fees set by the Board. The proposed Ordinance will allow the Board, by resolution, to waive or modify the fees for motor carriers and to modify the term of certificates and permits issued pursuant to Chapter 22½ to address the impacts of a declared state or local emergency.
