Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) approval is required for agreements with external agencies.

 

B. A waiver of a conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

Motion provides funds for the following services: medication management, care coordination, medical and specialty care for Broward County residents being served in a Post-Acute Sequela of COVID (“PASC”) Center.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This action supports the Commission’s value of “approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable” and the goal to “effectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The clinical center will implement comprehensive strategies and coordinated care from several sub-specialties to serve post-COVID patients.

Broward County Human Services Department is requesting Commission authorization for the appropriation and disbursement of general funds to South Broward Hospital District d/b/a Memorial Healthcare System (“MHS”), for a PASC Center. MHS will establish a clinical center to implement comprehensive strategies and coordinated care from several sub-specialties to serve 500-1,000 post-COVID patients for a pilot period of 12 months. MHS will work with the individuals to develop a detailed treatment and service plan based on the needs identified in the assessment.

Approval of this item gives the County Administrator authority to execute the Agreement to provide funding to MHS in the amount of $750,160, on a reimbursement basis, for eligible payroll expenses for employees providing services in the PASC Center. Retroactive approval to September 1, 2021, is requested to allow Memorial to request reimbursement for eligible payroll expenses to maximize utilization of funds.

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached hereto as Exhibit 1 and constitute full disclosure of any existing conflicts.
