Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the Contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development did not assign participation goals for this contract based on the sole brand request (Exhibit 2).

 

The purpose of this contract is to furnish and deliver mosquito control pesticides for the Highway and Bridge Maintenance Division and other Broward County agencies that may have needs for these services. 

 

On April 9, 2021, the Purchasing Division issued Request for Information (RFI) No. BLD2122737F1 to ascertain whether the Altosid® products were specified as a sole brand by the Highway and Bridge Maintenance Division. The RFI bid tabulation yielded four responses, three of the four responses from Clarke Mosquito Control Products, Inc. (Clarke), Target Specialty Products, and Veseris indicated that the only distributors of Altosid ® products are Clarke, Target Specialty Products, Veseris, Van Diest Supply Company, Helena, and Winfield. The fourth response from Orange Pest Control Inc. Services indicated that “We provide services. Not products”.

 

On May 14, 2021, the Director of Purchasing approved the sole brand designation.

 

On July 28, 2021, only two vendors responded to the bid: Clarke and Veseris; both vendors provided the same pricing. The Criteria for Breaking Ties, pursuant to the Procurement Code Section 21.41(h), determined that Veseris should be recommended for award.

 

On September 1, 2021, the Director of Purchasing approved the rejection of bidder, Veseris. The bidder was deemed non-responsive for not providing verification of compliance with Insurance Requirements within three business days. As stated in the Insurance Requirements form, “Vendor may be deemed non-responsive for failure to fully comply within stated timeframes”. The next recommended responsive and responsible vendor is Clarke. The difference in cost between Clarke and Veseris is $0 (Exhibit 1).

 

Highway and Bridge Maintenance Division reviewed the bid submitted by Clarke and concurs with the recommendation for award (Exhibit 3). Two evaluations were completed for Clarke; the firm has an overall rating of 4.00 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.

 

The Purchasing Division researched the prices submitted by the recommended vendor, Clarke, and determined that the prices submitted are fair and reasonable in comparison to prices of the previous vendor, Target Specialty Products (Exhibit 4).

 

Incumbent Vendor: Target Specialty Products. Contract Number and Title: Contract No. BLD2116682B1, Mosquito Control Supplies - Altosid. Contract Term: October 24, 2018 through October 23, 2021. Expenditures to date: $362,134.

 

The Recommendation for Award was posted on the Purchasing Division website from September 2, 2021 through September 9, 2021. No protest or appeal was filed against this procurement.

 

The bid posted on July 13, 2021 and opened on July 28, 2021; two bids were received with zero declinations.

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
