Title: MOTION TO AUTHORIZE County Administrator to execute a Third Amendment to the deliberately phased agreement between Broward County and The Weitz Company, LLC (Weitz) for additional Broward County Representative basic services required for the Convention Center Expansion and Headquarters Hotel Project (Project), retroactive to August 1, 2021, in the estimated amounts of $1,082,007 for Guaranteed Maximum Price (GMP) 2 and $240,758 for GMP 3, for a total amount of $1,322,765 to be reallocated within the existing contract budget, in substantially the form to be distributed as additional material, and authorize the County Administrator to include additional terms she determines are in the County's best interest, provided they do not impose any material additional financial obligation on the County, and provided the Third Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.

Why Action is Necessary

These actions are necessary because in accordance with the Broward County Procurement Code, Section 21.94.a, previously unapproved scope of services must be approved by the Board of County Commissioners.

 

What Action Accomplishes

A. This action will allow for completion of the West Expansion and the construction of the East Expansion foundation package (GMP 2) and the construction of the Hotel foundation package (GMP 3) including threshold testing and inspection services as required by building code.

 

B. This action also provides additional services by Weitz to assist County with schedule monitoring, pay request reviews and other project-related consulting and administrative support to the County’s Contract Administrator.

Summary Explanation/Background

This agenda item supports the Board's goal of increased economic strength and impact of revenue generating County enterprises balancing economic, environmental, and community needs.

 

On September 17, 2015 (Item No. 48), the Board of County Commissioners approved a deliberately phased agreement between County and Weitz for Phase I construction project management services associated with procurement assistance, contract development, design review and project management support for the Convention Center Expansion and Headquarters Hotel Project.

 

On June 11, 2019 (Item No. 65), the Board of County Commissioners approved a First Amendment that extended the original contract services and allowed the Contract Administrator to utilize Optional Services Work Authorizations to add construction phase basic services to Weitz’s scope related to GMP 1.


On June 16, 2020 (Item No. 33), the Board of County Commissioners approved a summer recess authorization that allowed the County Administrator to execute a Second Amendment with Weitz that further extended the original contract services and added construction phase basic services to Weitz’s scope related to GMP 2.

 

This Third Amendment further extends the original contract services and adds construction phase basic services to Weitz’s scope in a total amount of $1,322,765; $1,082,007 is related to GMP 2 for oversight of East Expansion foundation installation ($176,440) and completion of West Expansion items ($905,567), and $240,758 is related to GMP 3 for oversight of the Headquarters Hotel foundation installation. 

 

The request for retroactive payment results from a determination that a contract amendment rather than a work authorization (which was initially sought) was the appropriate mechanism to reallocate existing funds.  The funds for this work will be reallocated from the previously approved Optional Services line to the Basic Services line within the contract budget. No additional funding is required.

 

The Third Amendment is being drafted by the County Attorney’s Office and will be distributed as additional material.
