Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47.a, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided in the contract.

 

In accordance with the Broward County Procurement Code, Section 21.27, the Director of Purchasing may purchase goods or services (i.e., “piggyback”) under any procurement contract held by a governmental agency or nonprofit entity, or the County may enter into its own contract with the vendor under the originating contract if (a) the Director of Purchasing determines the originating contract was competitively procured in accordance with generally accepted standards of public procurement; (b) the originating contract expressly permits such purchasing, or the governmental agency or nonprofit entity that awarded the originating contract or the vendor who holds the originating contract (as applicable) allows the County to purchase therefrom; and (c) the terms and conditions offered to the County by the vendor do not materially deviate from the terms and conditions of the originating contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Values of “Cooperatively delivering an efficient and accessible regional intermodal transportation network” and “Encouraging investments in renewable energy, sustainable practices and environmental protection.”

 

The Office of Economic and Small Business Development reviewed the scope of work and determined that the purchase of buses with federal funding has been exempted from the Disadvantaged Business Enterprise (DBE) goal setting program by the U.S. Department of Transportation (DOT); therefore, no DBE goal is applicable to this project (Exhibit 1).

 

The purpose of this contract is to purchase 15 60-foot New Flyer Articulated Diesel Buses under the Washington State Transit Bus Cooperative, State Cooperative Purchasing Schedule Master Contract No. 06719-01, with New Flyer of America, Inc. The Transportation Department is in need of 15 60-foot New Flyer Articulated Diesel Buses to replace buses currently operating and scheduled for end-of-life replacement. New Flyer of America, Inc. has advised that it will deliver 15 buses by the end of 2022, as opposed to the industry standard lead-time of approximately 14 to 18 months from the notice to proceed. Additionally, using the State of Washington Department of Enterprise Services contract avoids abutting scheduled orders already committed to other transit agencies; New Flyer of America, Inc. meets all the County’s technical specifications requirements (Exhibit 2). This purchase is also time sensitive and will minimize operational and administrative support needed to prepare and complete a bid and provide for additional stocking of parts available in the Washington contract, which is more cost effective (Exhibit 3).

 

The State of Washington RFP No. 06719-01, Transit Buses - Heavy Duty, was competitively solicited as a Request for Proposal (RFP) by Washington State Department of Enterprise Services. The awarded contract to New Flyer of America, Inc. is currently in effect from April 1, 2021 through March 31, 2023, with three one-year optional renewals. The RFP was posted on March 4, 2020 and publicly opened on June 10, 2020 with 15 responses received. Three contracts were awarded to 12 different vendors. Contract No. 06719-01 was awarded to New Flyer of America, Inc. to provide heavy-duty (30, 35, 40, and 60 ft. sizes) bus rapid transit (BRT) articulated buses; with low-floor or high floor (over the road buses); and diesel power, hybrid drive, standard drive, CNG, or electric propulsion system; or any combination thereof. Buses have a minimum expected life of 12 years or 500,000 miles, whichever comes first. The $13,126,909 purchase cost consists of $12,640,593 for buses and $486,316 for additional options of spare parts, diagnostic and tooling, and training hours (Exhibit 5).

 

The purchasing agent and Transportation Department have determined that the utilization of the Washington State Transit Bus Cooperative, State Cooperative Purchasing Schedule Master Contract No. 06719-01, will allow for the County to benefit from economical pricing and reduction in delivery time, which is guaranteed by the State of Washington (Exhibit 6).

 

Utilization of this contract will also allow the County the ability to take advantage of lower costs available through competitive pricing based on large volume discounts and economies of scales, while reducing administrative costs of project solicitation (Exhibit 4).

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual quoted amount.
