Summary Explanation/Background

In 2020, the voters of Broward County approved a referendum that amended the Broward County Charter (“Charter”) to allow County ordinances to prevail over conflicting municipal ordinances when those County ordinances relate to the development of surtax-funded improvements to the countywide transportation system on County owned or County-leased property. A copy of the Charter amendment is attached as Exhibit 1.

 

Several municipalities sued the County and the Supervisor of Elections, seeking to invalidate the referendum election based on a claim that the ballot proposal misled the voters. That litigation has now been successfully resolved, through appeal, in the County’s favor.

 

If this item is approved, the Office of the County Attorney would collaborate with County staff and would seek the input of municipal counsel in developing the proposed Ordinance for the Board’s later consideration.
