MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, February 8, 2022, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE CONE OF SILENCE; REPEALING AND REPLACING SECTION 1-266 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

The proposed Ordinance was prepared at the direction of the Board of County Commissioners given at its meeting of August 24, 2021.

Summary Explanation/Background
The Cone of Silence, codified in Section 1-266 of the Broward County Code of Ordinances, restricts communication between potential vendors and certain representatives of the County during the pendency of a competitive solicitation.
The Board recently adopted a completely rewritten Broward County Procurement Code, Chapter 21 of the Broward County Administrative Code (“Procurement Code”), that went into effect on May 1, 2021. The Cone of Silence refers to provisions of the prior Procurement Code. The proposed amendment updates the Cone of Silence to refer to the current provisions of the Procurement Code and also seeks to simplify certain provisions to make them more easily understandable by individuals and entities subject to the Cone of Silence.
