Amends the Agreement between Broward County (“County”) and Cartaya and Associates Architects, P.A. (“Cartaya”) to provide funding for continued consultant services, update the Agreement language, and add two additional one-year renewal periods, extending the Agreement through June 1, 2024, at Broward County’s Fort Lauderdale-Hollywood International Airport (“FLL”) and North Perry Airport (“HWO”).

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action extends the term of the Agreement between the County and Cartaya through June 1, 2024, providing for continued consultant services for Building Projects at FLL and HWO.
The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise ("CBE") goal of 21% for this project. Cartaya committed to 50% CBE participation. To date, Cartaya has been paid $6,760,669, and has paid CBE firms $3,317,182, for 49.07% participation. Cartaya expects to reach their CBE commitment over the next six months with submittal of invoices for additional work performed (Exhibit 2).
On June 2, 2015 (Item No. 18), the Broward County Board of County Commissioners (“Board”) approved the Agreement between the County and Cartaya for Professional Consultant Services for FLL and HWO Airport, Building Projects, in the maximum not-to-exceed amount of $7,000,000, which included $6,650,000 for labor and $350,000 for reimbursable expenses. The initial term of the Agreement was for three years with two additional one-year renewal periods, through June 1, 2020.
On August 14, 2018 (Item No. 7), the Board approved the First Amendment to the Agreement, for additional scope, for updated Agreement language, for an increase in the amount of $5,000,000, which included $4,650,000 for labor and $350,000 for reimbursable expenses, for a revised total Agreement amount of $12,000,000, and extended the Agreement term for two additional one-year renewal periods, through June 1, 2022.
Cartaya currently provides professional architectural and engineering services for multiple capital development projects in process at FLL. All remaining agreement funds, approximately $3,000,000, are allocated to these projects. The Broward County Aviation Department (“BCAD”) has identified construction phase work that would result in additional services provided by Cartaya under this Agreement. As such, BCAD is requesting an additional $1,000,000 for these projects, which include the Rental Car Center and Garages improvements, two Terminal Connectors (between Terminals 1 and 2 and between Terminals 2 and 3), replacement of Terminal 1 Concourse B and C windows, security enhancements for the South Runway, Information Systems communication rooms; and rehabilitation of the Terminal 1 pedestrian bridge. Cartaya will provide construction phase services to include: construction administration services, bid and award services, and resident project representative/inspection services, which are required throughout the duration of the projects.
The proposed Second Amendment also amends Section 4.1, Articles 5, 8.6 and 10.15 of the Agreement and updates the Compliance and General Provisions of the Agreement, as outlined in the Second Amendment (Exhibit 1).
Approval of the proposed Second Amendment increases labor by $1,000,000, for a total revised labor amount of $12,300,000, with no change to the previously approved reimbursable amount of $700,000, for a revised total Agreement amount of $13,000,000, and extends the term of the Agreement to June 1, 2024.
The proposed Second Amendment has been reviewed and approved as to form by the Office of the County Attorney.
