Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.19(a), the Board is required to approve all standardizations greater than the award authority of the Director of Purchasing; and Section 21.19(c), the Director of Purchasing may recommend to the Board that any brand or source of goods or services be standardized as the sole brand or sole source of goods or services that will be purchased for a County Agency or countywide.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
On June 6, 2017 (Item No. 34), the Board approved Agreement No. X2111385P1 with Shanghai Zhenhua Heavy Industries Co., Ltd. Inc. DBA ZPMC NA East Coast Inc (ZPMC) for the initial purchase of three Low Profile Super Post Panamax Container Handling Gantry Cranes (Cranes). The Agreement included the purchase option of three additional Cranes. The Port Everglades Department (Port) has procured three cranes, which are currently in service. These cranes are among the most technically advanced container cranes in the world.
On September 10, 2021, the Port exercised the option to procure three additional identical cranes. The additional three cranes are scheduled to arrive September 2023.
On January 27, 2022, the Purchasing Division posted a Request for Information (RFI)/Notice of Intent to ascertain if the container cranes, crane parts, maintenance, engineering, repairs, and retrofits are available from other providers/brands. On February 9, 2022, the RFI closed with a single response received from the manufacturer stating that ZPMC is the sole source provider.
Based on the 40-year service life of the container cranes, standardization of the Low Profile Super Post Panamax Container Handling Gantry Cranes, parts, materials, and maintenance services will ensure continuous operations of the cranes at Port Everglades (Exhibit 1).
