Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000 inclusive of the value of any renewals or extensions provided for in the contract.

 

In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service airport in excess of the threshold amount provided in § 287.017 for CATEGORY FIVE [i.e., $325,000] as a separate line item on the agenda and must provide a reasonable opportunity for public comment. Such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development did not establish County Business Enterprise (CBE) goals for this procurement because there are currently no CBE certified firms that provide these services (Exhibit 1).

 

The confidential exhibits referenced in the action describe specific information regarding the Airport Security Program and are considered to be Sensitive Security Information (SSI). No part of such exhibits may be disclosed to persons without a "need to know" SSI as defined in 49 Code of Federal Regulations Parts 15.11 and 1520.11, except with the written permission of the Administrator of the Transportation Security Administration or the Secretary of Transportation. Pursuant to this regulation, the contract exhibit is not included as part of the agenda item and will be provided under separate cover.

 

Three bidders were identified with lower prices, but were rejected for specifically failing to meet pricing and other requirements delineated in the Invitation to Bid solicitation Specifications and Requirements.

 

The initial three-year amount was derived from the lease total amount of $1,008,000 ($336,000 lease annual amount, multiplied by three years), plus the one-time purchase total amount of $589,059, totaling to $1,597,059. The potential five-year amount was derived from the lease annual amount of $336,000 multiplied by five years, plus the one-time purchase total amount of $589,059, totaling to $2,269,059. The option to purchase the equipment was included in both the initial and potential term estimated amounts.

 

The Recommendation for Award posted on the Purchasing Division website from April 12 - 19, 2022. There was no protest or appeal filed regarding this procurement.

 

The initial contract period shall start on June 27, 2022 and shall terminate three years from that date.
