In accordance with the Broward County Procurement Code, Section 21.56, Broward County Board of County Commissioners (“Board”) approval is required for change orders of $250,000 or more.

Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This action provides funding for additional work and extends the contract duration by 79 days for the RCC Project at FLL.

 

The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 25% for this Agreement.  West Construction, Inc. (“West Construction”) committed to 28.17% CBE participation. To date, West Construction has been paid $8,025,091 and has paid CBE firms $1,473,418, for 18.36% participation (Exhibit 2). 

 

On August 25, 2020 (Item No. 42A), the Board approved the Agreement between Broward County (“County”) and West Construction, Inc. (“West Construction”) for the RCC Project in the amount of $11,716,089, which included contract allowances for permitting, regulatory agency fees and standardized sole source/sole brand items, in the amount of $729,614, to be substantially completed 240 calendar days from the Project Initiation Date listed in the Second Notice to Proceed.  In addition (Item No. 42B), the Board approved an increase in the administrative change order allowance, from 5% to 15%, to address unforeseen conditions and additional maintenance of traffic.  Additional information on the Agreement and subsequent actions is included in Exhibit 3.

 

The RCC includes a fuel facility that services the Rental Car Companies by providing a space referred to as the Quick Turnaround Area (“QTA”). This area is used by the Rental Car Companies to refuel and clean the rental vehicles before returning them to service.  During construction at the fuel facility, its staff and Broward County Aviation Department (“BCAD”) staff determined that the existing fuel dispensers (“dispensers”) installed in the QTA have reached their end-of-life expectancy, and should be replaced due to age, deterioration, and obsolescence. The end-of-life expectancy of the dispensers is 15 to 20 years and the installed dispensers are 18 years old.

 

The existing scope of work for the Project provides for the replacement of the internal components within the dispensers, but does not provide for replacement of the external dispensers. Accordingly, the County will save significant labor costs by having the dispensers replaced while other related work is occurring.  Additional work is required to procure, replace, and install 63 new external dispensers, and associated support components including emergency stop switches. Completion of this additional work will provide the County with an efficient, upgraded, fuel dispensing system, which will improve service to the rental car companies and FLL passengers.

 

Approval of the proposed Change Order No. 7 for this work will extend the contract duration by 79 days, increasing from 761 days to 840 days, revise the substantial completion to May 10, 2023, and increase the total Agreement amount by $1,120,328, from $12,711,803 to $13,832,131. 

 

The proposed Change Order No. 7 has been reviewed and approved as to form by the Office of the County Attorney. At time of submission of this action, Change Order No. 7 had not been executed by all pertinent parties. BCAD will submit Change Order No. 7 to the Board prior to its consideration of this action on May 24.
