Why Action is Necessary
Section 712 of Resolution 2012-320, pertaining to the Airport System Revenue Bonds, requires that before removal or demolition of property within the Airport System, the Broward County Board of County Commissioners (“Board”), must determine, by Resolution, that the demolition of structures will not impair the operating efficiency of the Airport System or reduce the revenue-producing capability of the Airport System.

This action approves a proposed Resolution that contains the determinations required by Resolution No. 2012-320 before structures that are part of the Airport System may be demolished.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action approves a proposed Resolution, authorizing the demolition of a structure consisting of approximately 15,500 square feet; a garage/warehouse structure consisting of approximately 3,000 square feet; and an open garage with a roof and pillars without walls (“Obsolete Structures”) located at North Perry Airport (“HWO”).
Since 1987, the U.S. Border Patrol (“Border Patrol”) sub-leased the property at HWO from Gallier Enterprises (“Gallier”). In September 2009, the Border Patrol terminated its Sublease with Gallier. As a result, Gallier requested a mutual termination of its Agreement with Broward County, which occurred on April 30, 2012.
Between 2012 and 2018, the property in which the Obsolete Structures are located was under a lease, however, it was cost prohibitive for the leaseholder to develop the property. Therefore, the lease agreement was terminated. The Obsolete Structures have been vacant for more than ten years and have limited use due to their poor condition. In 2018, the Broward County Aviation Department (“BCAD”) advertised Requests for Letters of Interest for the property in which the Obsolete Structures is located. Due to the complexity of developing the property, BCAD was not able to move forward in securing a lease agreement for same. The demolition of the Obsolete Structures will allow BCAD to utilize the property for a more suitable aeronautical purpose.
The proposed Resolution has been reviewed and approved as to form by the Office of the County Attorney.
