Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL.
This item supports the Board of County Commissioners' Value of "Encouraging investments in renewable energy, sustainable practices and environmental protection" with the goal to "increase water quality protection efforts and lead creative approaches to water storage and aquifer recharge, as well as diversification of water supplies, regionally."
The project will construct two parallel pipelines for 3.5 miles between the County’s North Regional Wastewater Treatment Plant (“NRWWTP”) and the City of Pompano Beach’s OASIS Reuse Facility (“City”). One pipeline will transmit wastewater effluent from the NRWWTP to the City and the other will be a water reuse interconnection between both entities. This City and County partnership will provide a solution to regional wastewater management and water reuse production challenges as well as mitigate risks associated with natural disasters such as hurricane events, droughts, and saltwater intrusion. It will also benefit the 11 large users who utilize the County’s NRWWTP for effluent management.
The City, one of the large users, has the capacity to produce 7.5 million gallons per day of water reuse. As the County and its NRWWTP come into compliance with the state of Florida Ocean Outfall Law by 2025, the City’s OASIS Water Reuse Facility will no longer have a source of effluent to produce water reuse. This project will provide them with a direct source of effluent ensuring their ability to continue producing water reuse into the future, thus conserving South Florida’s traditional drinking water source - groundwater. The water reuse interconnect, between the City and the NRWWTP Water Reuse Facility, strengthens regional resiliency by increasing options and redundancy for both the County and City in distributing water reuse in the north part of the County, in addition to conserving groundwater and mitigating against drought and saltwater intrusion.
In September 2020, Broward County applied for a $6.25 million Rebuild Florida Mitigation General Infrastructure Program Grant administered by the DEO to assist with funding the Regional Effluent and Reuse Interconnect Project. The program is supported through “first-of-its-kind” U.S. Department of Housing Urban Development Community Development Block Grant Mitigation funds. In April 2021, the State of Florida announced the County’s project as one of its successful awardees. The total reimbursement payments by the DEO for all work done shall not exceed $6,250,000 and the County's Water and Wastewater Services will contribute matching funds for the remaining total project amount of $12,500,00 or the remainder of actual final costs.
This agreement (Exhibit 1) is effective as of the date DEO executes this Agreement and 48 months after execution by DEO, unless otherwise terminated as set forth in contract. It does not include the County’s standard agreement provisions because the DEO requires the use of their grant form agreement. Among the non-standard provisions are contracting requirements placed on County as shown in Section 18 of the agreement, additional contracting requirements as shown in Attachment L and the requirement that the County must provide the DEO ten days’ notice before any solicitation for this work is posted. Additionally, there is a subrogation agreement in Attachment M that includes assigning all future rights to the DEO for reimbursement of all payments from any grant, subsidized loan, lawsuit or insurance policies or any reimbursement or relief program administered by the Federal Emergency Management Administration or the Small Business Administration.
