Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for agreements with external agencies and to authorize the County Administrator to execute the agreements as amended.

 

B. Section 129.06(2)(d), Florida Statutes, requires a budget resolution to recognize revenue.

 

C. A waiver of a conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable” and the goal to “effectively advocate for and acquire municipal, state, and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The Florida Department of Law Enforcement (“FDLE”) funding allows Broward County to purchase homeless shelter security surveillance equipment upgrades, provide a comprehensive array of integrated mental health and substance use disorder treatment services, and purchase updated equipment and accessories for street outreach services that benefit individuals and families within Broward County.

 

The U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance provides program funding to improve the criminal justice system to reduce violence and crime by funding initiatives within state and local agencies. FDLE is responsible for distributing Edward Byrne Memorial Justice Assistance (“JAG”) grant program funds through a designated, formula-based, non-competitive application process.

 

On June 15, 2021 (Item No. 20), the Commission authorized the County Administrator to submit JAG applications on behalf of Broward County to FDLE to provide homeless shelter security upgrades, juvenile justice services, mental health and substance use services, and street outreach services for individuals and families experiencing homelessness.

 

FDLE provided Broward County the JAG program funding allocation notice dated January 13, 2022, for homeless shelter security upgrades (Exhibit 3). FDLE also provided the program funding allocation notices dated March 17, 2022, for mental health and or substance use disorder treatment services (Exhibit 4), and for updated equipment to be used for street outreach services for individuals and families experiencing homelessness (Exhibit 5). All program funding allocation notices are for the grant period from October 1, 2021, through September 30, 2022.

 

The Human Services Department (“HSD”) requests Commission approval to amend agreements with specified service providers (Exhibit 1, Attachment A) previously selected via a fair, open, and competitive Fiscal Year 2022 General Services Request for Proposals that closed on April 8, 2021. Commission approval is also requested to authorize the County Administrator to execute amendments to existing agreements. This item requests retroactive approval of amendments to agreements effective October 1, 2021, as HSD did not receive the final notice of award until March 17, 2022. HSD also requests Commission approval of the revised Byrne Grant Addendum to align with FDLE requirements (Exhibit 1, Attachment B).

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 6 and constitute full disclosure of any existing conflicts.

FDLE JAG grant funding in the amount of $348,691 will be available within the Edward Byrne Grant Fund. The program(s) would be discontinued if grant funding were no longer available.
