Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 25% for this contract. Juniper Landscaping of Florida, LLC dba Juniper committed to 25% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).

 

The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary to perform greenways and miscellaneous landscaping maintenance at various Broward County locations for the Highway and Bridge Maintenance Division.  All prices, terms and conditions will remain fixed for the initial one-year contract period. Upon completion of the initial contract period, the contractor may make a timely request for an annual price adjustment, prior to the renewal date, for years two through three, in accordance with the price adjustment clause term of the contract.

 

The allowances incorporated in the contract in the total estimated annual amount of $97,000 is for miscellaneous services (items not defined but contract related irrigation repairs and modifications), $85,000; parts and materials, $10,000; and permits and fees, $2,000. Expenditures under these allowance items must be approved by the contract administrator; and will be reimbursed at the contractor’s actual incurred cost, without markup (Exhibit 1).

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program.  Juniper Landscaping of Florida, LLC dba Juniper has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code, Section 26-101 (i), these services are covered services. Juniper Landscaping of Florida, LLC dba Juniper has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

 

The apparent low bidder, Weed-A-Way, Inc., does not have all of the required licenses as indicated in the solicitation. Pursuant to the Special Instructions to Vendors’ License Requirements, it required the vendor to possess at the time of solicitation submittal a State Certified Plumbing Contractor License, Irrigation Specialty Contractor License, a County Master Plumbing Contractor License, or Irrigation Specialty Contractor License in conjunction with a County Tree Trimmer License Class “A” or “B”.  Weed-A-Way, Inc. only possesses the County Tree Trimmer License Class “B”.  The Director of Purchasing deemed that the apparent low bidder, Weed-A-Way, Inc., to be non-responsive to the solicitation’s license requirements.

 

Highway and Bridge Maintenance Division reviewed the bid submitted by Juniper Landscaping of Florida, LLC dba Juniper and concurs with the recommendation for award (Exhibit 3). There have been no performance evaluations for Juniper Landscaping of Florida, LLC dba Juniper.

 

The Purchasing Division has researched the prices submitted by the recommended bidder, Juniper Landscaping of Florida, LLC dba Juniper, and determined that the prices submitted are fair and reasonable in comparison to prices of competing firms and the current contract prices (Exhibit 4).

 

Incumbent: Prestige Property Maintenance, Inc.; Contract Number and Title:  BLD2115965B2, Maintenance of Greenways and Miscellaneous Landscaping.  Contract Term:  April 16, 2019 through July 14, 2022.  Expenditures to date:  $2,718,125.

 

The Recommendation for Award posted on the Purchasing Division website from April 13, 2022 through April 20, 2022.  There was no protest or appeal filed against this procurement.

 

The bid posted on November 30, 2021 and opened on December 22, 2021; six bids were received with one declination (Exhibit 1). Bid validity extension from Juniper Landscaping of Florida, LLC dba Juniper was secured through July 21, 2022. The reason for the bid validity extension was due to extensive review of the bid responses.

 

The initial contract period shall begin July 15, 2022 and will terminate one year from that date.
